Dewberry Farm Operation, LLC
Assumption of Risks, Waiver Release, and Indemnity
In consideration of the services of Dewberry Farm, I, as an adult (18 years or older) guest,
or the parent or legal guardian of a guest who is a minor (the child), acknowledge and agree as
follows:
Dewberry Farm is an outdoor agri-entertainment venue that features many entertainment
attractions and activities in a rustic farm and ranch setting. As such, as a guest of Dewberry
Farm I understand that I will encounter conditions at Dewberry Farm consistent with a farm and
ranch setting, including but not limited to unpaved dirt or gravel walkways, dirt, mud, gravel,
gravel, rocks, wooden decks, fences, walkways, livestock and other farm animals. I understand
that as part of my experience at Dewberry Farm I will have access to certain attractions,
including but not limited to slides, jumping pillow and other playground equipment that can be
dangerous and include the inherent risks of falls and collisions with other persons, structures or
equipment, resulting in breaks, sprains and other trauma, that can be severe or debilitating.
I assume ALL risks of attractions and use of any equipment, whether or not described above;
and if the guest is my minor child or ward, I have discussed the risks with the child who
understands them and wishes to participate, nevertheless. Additionally, on behalf of the minor
child or ward, I assume ALL risks of attractions and use of any equipment, whether described
above or not.
WAIVER
For myself, and if the guest is my minor child or ward, on behalf of the child, I waive and forever
relinquish the right to seek recovery from Dewberry Farm Operation, Peerless Production
Group and their respective owners, members, directors and staff, agents and representatives
for any and all claims of personal injury, death or other loss, suffered or caused by me or the
child, related in any way to my, or the child’s, use of one of the aforementioned attractions.
RELEASE AND INDEMNITY
*PLEASE READ CAREFULLY*
I FURTHER FOR MYSELF, AND IF THE GUEST IS MY MINOR CHILD OR
WARD, ON BEHALF OF THE CHILD AGREE TO RELEASE, NOT TO SUE,
AND TO INDEMNIFY (PROTECT) DEWBERRY FARM OPERATION,
PEERLESS PRODUCTION GROUP AND THEIR RESPECTIVE OWNERS,
MEMBERS, DIRECTORS AND STAFF, AGENTS AND REPRESENTATIVES
(“RELEASED PARTIES”) WITH RESPECT TO ANY AND ALL CLAIMS OF
PERSONAL INJURY, DEATH OR OTHER LOSS, SUFFERED OR (FOR THE
PURPOSES OF INDEMNITY) CAUSED BY ME OR THE CHILD, RELATED IN
ANY WAY TO MY, OR THE CHILDS, USE OF ANY PART OF DEWBERRY
FARMS. THIS AGREEMENT INCLUDES PREPARATIONS TO RIDE THE
ATTRACTIONS. IT ALSO INCLUDES CLAIMS OF NEGLIGENCE, WHETHER
THE SOLE NEGLIGENCE OR PARTIAL NEGLIGENCE (BUT NOT GROSS
NEGLIGENCE OR INTENTIONALLY WRONGFUL CONDUCT) OF THE
RELEASED PARTIES.
By signing this Assumption of Risks, Waiver, Release and Indemnity, I acknowledge that I have
read it and have agreed to all the terms and conditions.Tickets are non-refundable and all sales are final. Operating hours are subject to change. Operating hours for specific Attractions and Food locations may vary from Farm Operating Hours. Attractions are subject to availability and may not operate due to inclement weather, mechanical difficulties, or the time of year. 2026 Season Passes, and any other non Field Trip specific ticket, are not valid on School Field Trip days. Season Passes are non-transferable and expire after December 27th, 2026. There may be a $2.00 fee per ticket, for any date or time changes we are requested to make to your original order. Please check our website for details and scheduled operating hours.
All Ticket holders grant Dewberry Farm Operations, LLC the right to film, video, or photograph Ticket Holders for any purpose whatsoever without any payment or compensation of any kind. In the event of mechanical failure or inclement weather, such as electrical storms heavy rain, or high winds, Dewberry Farm may close any of the attractions without notice until the weather has cleared.

Tickets are valid for one day only (unless a Season Pass). Ticket Holder must have their hand stamped for re-entry if they leave the farm and would like to return the same day..
Tickets cannot be duplicated. If a copy is made, the first scanned ticket will allow entry and anyone using a duplicated ticket will be denied admission. Farm staff will check a photo id for verification.
All tickets/Season Passes are non-refundable. Ticket Fees are also non-refundable.
Tickets may be exchanged for a different day if done so before the day the ticket is valid for. There is a $2.00 change fee per ticket for changing dates. Tickets may only be exchanged for the current calander season and not for another season.
The holder of this ticket assumes all responsibilities for any risk of bodily harm or loss of property sustained while attending this attraction, and waives all rights to lay claim for any damages resulting from any cause whatsoever either before, during, or after the attraction.
Under Texas Law (Chapter 75A, Civil Practice and Remedies Code), an Agritourism Entity in not liable for any injury to or death of an Agritourism Participant resulting from an Agritourism Activity.
